MOTION NOTION Ticket Terms & Conditions

PLEASE READ CAREFULLY. BY PURCHASING OR USING THIS TICKET YOU ARE AGREEING TO THESE TERMS AND CONDITIONS WITH MOTION NOTION LTD. (“Motion Notion”).

Tickets are valid for the August 16th – 19th, 2024 festival only (the “Festival”). Motion Notion reserves the right to change the dates of the Festival upon notice to you. Each ticket must include the name of the person who be attending the Festival. Tickets are non-transferable unless transferred by the Showpass Ticketing website and system or if the named ticket holder is physically present at the gate of the Festival upon use of such ticket, then tickets may be transferred to another person at the sole discretion of Motion Notion, such permitted transfer is subject to these Terms and Conditions being met by the transferee. Any ticket that has been duplicated, altered, disfigured, defaced, destroyed, made illegible or electronically or otherwise unreadable, or tampered with is invalid, and Motion Notion shall in its sole discretion make such determination. Motion Notion highly recommends that you only purchase tickets through the Motion Notion website at: www.MotionNotion.com.

All tickets are non-refundable. Motion Notion will not issue refunds for any reason, including without limitation, if the Festival, or any part thereof, is terminated early or cancelled for any reason including due to weather, acts of God, terrorism, safety concerns, health requirements, government or similar authority regulations, restrictions, orders, requirements, or decisions. Motion Notion will not issue refunds for any failure or inability of the ticket holder to use the ticket howsoever arising, including without limitation due to illness, positive co-vid tests, acts of God, public health crisis, government or similar authority regulations, restrictions, orders, requirements, or decisions, travel-related problems, or other conditions whether or not beyond the control of Motion Notion. If all or any portion of the Festival is cancelled or terminated for any reason, you agree that you will not seek remedy against Motion Notion at law, in equity or otherwise, including, without limitation, for a refund of payments made, expenses incurred, or any actual, consequential, or punitive loss or damages of any kind, regardless of whether such loss or damage was foreseeable or Motion Notion was advised of the same.

The Festival is an “18+” event which will only permit entrance of those individuals 18 years of age or older, valid photo identification in a form reasonably required by Motion Notion (e.g. government issued) is required for entry to the Festival. By purchasing a ticket to the Festival you represent to Motion Notion, that you are over the age of 18 years and that you have the legal capacity to enter into this agreement. Motion Notion reserves the right, at its sole discretion, to refuse entry to anyone without refund of ticket. Tickets are a non-exclusive and revocable license to enter and attend the Festival (or a portion thereof as the case maybe) and may be revoked at any time, for any reason (e.g., including without limitation for the safety of the public, attendees, or you), without compensation and in the sole discretion of Motion Notion. During your attendance at the Festival, you agree to follow any and all laws and any rules, regulations, requirements, and guidelines set by Motion Notion and you shall not do any act or omission that does or could cause injury, harm, or damage to any person or thing at the Festival or otherwise.

You and all attendees and vehicles at the Festival may be subject to searches prior to entry and while at the Festival. PLEASE NOTE that certain items are prohibited at the Festival including glass bottles, mirrors, weapons, bear spray, firearms, axes, hunting knives, box-cutters, flares, fireworks and pets (guide dogs are permitted with pre-registration), illegal drugs, prescription drugs (without a prescription). Prohibited items are subject to seizure by Motion Notion and Motion Notion is not responsible for any confiscated items and may dispose of same in its sole discretion and at your sole cost.

Festival tickets include free camping in the general camping areas (excluding reserved sites), as determined by Motion Notion in its sole discretion and is subject to availability on a first-come-first-served basis. Additional camping sites may be available as designated by Motion Notion for Reserved Group Camping Sites, at a rate and under terms and conditions to be set by Motion Notion. Motion Notion makes no representations or warranties regarding the availability, use, nature or extent of such camping areas and you are solely responsible for all your personal property at such area and at the location of the Festival at all times. Any vehicles or camping equipment or facilities are at the sole discretion of Motion Notion who may prohibit or set any terms or conditions on entry to or use at the Festival. Any vehicle entry to the Festival shall be subject to an additional entry fee in addition to the cost of entry tickets per attendee. Any re-entry of any vehicle to the Festival will be charged a fee per vehicle payable prior to re-entry. Vehicle entry and re-entry fees are in addition to any general admission ticket cost for attendees to the Festival. Parking or camping is only permitted in the areas designated by Motion Notion and not permitted on the roads leading to the Festival location or in fire lanes/roads within the Festival location. Any failure to follow rules or designations made by Motion Notion and Motion Notion may remove, tow, move, or re-locate without notice or liability any vehicle, tent, trailer, structure, supplies, equipment or item as it sees fits in its sole discretion at your cost. No unauthorized vending, soliciting, or promoting of any wares or services, whether at or related to the Festival or otherwise, is permitted at the Festival. Motion Notion does not supply nor warrant the availability of any service including any wi-fi or cell service at the Festival or at all, it is possible that you may need to attend surrounding areas (e.g. Sundre, Alberta) for availability of the same as provide by third parties.

By attending the Festival, or any portion thereof, you acknowledge and agree that Motion Notion and third parties will be photographing, filming and recording portions of the Festival and its attendees, and may distribute such footage including for promotional uses in relation to Motion Notion and/or future events similar to the Festival. You hereby grant a non-exclusive, world-wide, irrevocable, royalty free licence in perpetuity to Motion Notion to use images and videos of or which may contain your likeness and to use, distribute and authorize the use, editing, commercialization, or distribution of such footage for its own use (including promotional purposes) in its sole discretion. Any and all intellectual property howsoever rising from such footage or the Festival, or any portion thereof, including without limitation copyright, shall belong to Motion Notion and you waive any and all moral rights howsoever relating thereto. The obligations contained in this Article shall survive this Agreement.

In consideration of obtaining this ticket and attending the Festival (or any part thereof) YOU ARE AGREEING AND ACKNOWLEDGING that you are voluntarily participating in the Festival and that you accept and assume any and all risks, dangers, and hazards howsoever arising or related to your participation in or attendance at the Festival which shall be at your sole risk. YOU AGREE TO THE FOLLOWING ASSUMPTION OF RISKS, RELEASE, CLAIMS AND INDEMNITY and you shall sign a separate agreement containing substantially the same terms and conditions at the Festival if requested by Motion Notion as a condition of entry to the Festival, as follows:

Disclosure of Common Risks: The following are some, but not all, of the inherent risks, hazards and dangers that participants in the Festival may be exposed to: equipment malfunction or breakage, interaction with people, animals or insects, allergic reactions, any slip, trip or fall, exposure to inclement weather and other outdoor conditions, vehicular and other travel hazards, aggravation of existing injury or condition, negligence on the part of Myself, others, and Motion Notion, and loss, theft or damage of My personal property. Further, I understand that by participating in the Festival, I may be exposed to the novel Coronavirus/COVID-19 or other virus or illness. Motion Notion makes no representations or claims as to the condition or safety of any land, structures, or surroundings, whether or not owned, leased, operated or maintained by Motion Notion.
Assumption of Risks: I understand that participation in the Festival comes with certain risks, hazards, and dangers, including but not limited to those described above, and as a result I may suffer serious injury, or even death, from without limitation slipping, tripping, or falling, over-exertion, exhaustion, medical emergency, negligence on the part of Myself or other participants in the Festival, and NEGLIGENCE ON THE PART OF MOTION NOTION, INCLUDING THE FAILURE ON THE PART OF MOTION NOTION TO SAFEGUARD OR PROTECT ME AND OTHERS FROM THE RISKS, HAZARDS AND DANGERS OF THE FESTIVAL.
Release of Liability and Waiver of Claims: I hereby waive all claims that I have or may have in the future against Motion Notion, and I release Motion Notion from all liability for any loss, damage, expense, or injury, including death, that I may suffer as a result of My participation in the Festival due to any cause whatever, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, OR IN RESPECT TO MOTION NOTION'S PROVISION OF OR FAILURE TO PROVIDE ANY WARNINGS, DIRECTIONS OR INSTRUCTIONS OR DUE IN ANY WAY TO THE RISKS, HAZARDS AND DANGERS OF PARTICIPATION IN THE Festival.
Indemnity: I hereby indemnify and save harmless Motion Notion from all liability, including without limitation, for any injury, death, damage or expense, to any person or property, howsoever arising, resulting from My participation in the Festival.
Policies and Instructions: I understand and accept Motion Notion's rules, policies and procedures, and I will abide by all of Motion Notion's instructions. I agree that Motion Notion reserves the right to refuse My participation in the Festival if Motion Notion believes My participation may be unsafe for Myself or others.
Pre-existing Conditions: I understand it is my responsibility to consult with an appropriate medical practitioner prior to My participation in the Festival. I represent and warrant that I have fully disclosed to Motion Notion any conditions or circumstances that may affect My ability to participate in the Festival, increase My risk of injury, or have an impact on Me or Motion Notion.
COVID 19 Declaration: I certify that I: (a) have not travelled outside of Canada in the past 14 days; (b) have not had close contact with a person who tested positive for COVID-19; (c) am not experiencing any of the following symptoms: cough, fever, shortness of breath, runny nose, or sore throat that is not related to a pre-existing illness or health condition; and (d) have not been legally required to self-isolate in the past 14 days. If at any time the above statements become untrue, I represent and warrant to Motion Notion that I will refrain from participating in the Festival, and I will follow Alberta Health Service's COVID-19 guidelines.
In entering into this Agreement, I am not relying on any oral or written representation or statements made by Motion Notion with respect to the safety of Festival, other than what is set forth in this Agreement. I acknowledge that Motion Notion has not offered or provided any legal advice about the contents of this Agreement and that I had ample opportunity to review the Agreement in detail prior to engaging Motion Notion.
